CONDUCT: This Sweepstakes is governed by these official rules (“Official Rules”). By entering this Sweepstakes, entrants agree to be bound by these Official Rules and that the decisions of the Sponsor shall be final and binding in all respects. The Official Rules will be posted on the following website throughout the Sweepstakes Period: https://rewards.goodtimestobacco.com/ Failure to comply with these Official Rules may result in disqualification. The Sponsor reserves the right at its sole discretion to disqualify any individual found: to be tampering with the entry process or the operation of the Sweepstakes or the website; to be acting in any manner deemed by the Sponsor to be in violation of the Official Rules; to be acting in any manner deemed by the Sponsor to be unsportsmanlike or disruptive; or with intent to annoy, abuse, threaten, or harass any other person.

ELIGIBILITY:

NO PURCHASE NECESSARY TO ENTER THE SWEEPSTAKES OR WIN PRIZE. A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING. To enter the Sweepstakes, entrants must: (i) be 21 years of age or older at the time of entry; (ii) be a legal resident of one (1) of the 50 United States or the District of Columbia (excluding residents of New York, Puerto Rico, U.S. Territories and possessions, foreign-based United States Military Installations, or where otherwise restricted or prohibited by law); (iii) not be considered a minor or legally incompetent in your state of residence; and (iv) be a current user of tobacco or nicotine products. The Sweepstakes is void in New York,Puerto Rico, U.S. territories and possessions, in any foreign-based United States military installations, and where otherwise restricted or prohibited by law. The Sweepstakes is subject to all applicable federal, state, and local laws and regulations. Employees, officers, shareholders, and directors (as well as any immediate family member of and any person living in the same household as any employee, officer, shareholder, or director) of the Sponsor, its affiliates, subsidiaries, licensees, and agencies, and those of any other person or entity involved with the design, production, execution, or distribution of this Sweepstakes are not eligible to participate in the Sweepstakes or to win any prizes. Additionally, employees, officers, shareholders, and directors (as well as any immediate family member of and any person living in the same household as any employee, officer, shareholder, or director) of any distributor or retailer of GT products are not eligible to participate in the Sweepstake or to win any prizes. Any Sweepstakes entries received from an ineligible participant will be disqualified.

HOW TO ENTER

All methods of entry have an equal chance of winning. All entries become the property of the Sponsor and will not be acknowledged or returned. Unless otherwise specified, all entries must be submitted during the Sweepstakes Period.

There are two (2) ways to enter the Sweepstakes:

1. Scan the QR Code on any Good Times Product or enter the numerical code on any Good Times Product using the GT Rewards Website: During the Sweepstakes Period, purchase a GT Product and, while logged into your registered GT Rewards account on the GT Rewards Website https://rewards.goodtimestobacco.com/, either scan the quick response code (“QR code”) on the GT product’s packaging or enter the numerical code [on the back of Good Times Pouches]. To register for a GT Rewards account, visit https://rewards.goodtimestobacco.com/register/ and follow the instructions. You will receive one (1) entry into the Sweepstakes per eligible item, and no additional entries will be awarded for entry of a product’s numerical code after the QR code has been scanned or vice-versa. If you are unable to scan a QR code, are unable to enter a numerical code, or experience technical issues with the Sweepstakes entry process, please contact GT at GTmarketing@goodtimestobacco.com obtain information on an alternative method of entry or instructions for receiving an entry in response to the submission of proof of purchase satisfactory to the Sponsor in its sole discretion. If you wish to opt-out of the Sweepstakes but wish to continue to scan GT product QR codes for the purpose of accumulating GT Rewards, you may hand print your name, date of birth, phone number, zip code, and email address associated with your GT Rewards account on a piece of paper and mail it in an envelope with proper postage to PO Box 16643 Tampa, FL, 33637. You may also opt-out of the Sweepstakes by sending an email containing the above information to GTmarketing@goodtimestobacco.com .Your opt-out request will be applied after receipt. Your opt-out request must be postmarked (if your opt-out request is sent by mail) by April 9^th, 2024 and received (in case of requests sent by mail or email) by April 18^th, 2024 in order for your entries to be removed from the drawing(s).

2. Free Mail-In: To enter without a purchase, hand print your full name, street address (no P.O. boxes), day/evening/cellular phone number (if any), email address, and date of birth on a 3” x 5” piece of paper and mail it in an envelope with proper postage to Good Times USA LLC, Attn: Sweepstakes NPE, P.O. Box 16643, Tampa, FL 33687. You will receive one (1) entry into the Sweepstakes per stamped envelope sent via USPS. You will receive one (1) entry per envelope and/or package sent via any other shipping method. All mail‑in entries must be handwritten, postmarked by April 19^th, 2024 and received by the Sponsor by April 26^th, 2024 at the address above to be eligible. All entries become the exclusive property of the Sponsor, and none will be acknowledged or returned. The Sponsor is not responsible for lost, late, incomplete, invalid, unintelligible, illegible, misdirected, or postage-due entries, which will be disqualified. 

Entry methods are subject to, and will be treated in a manner consistent with, the official GT Rewards Program’s Terms and Conditions at https://rewards.goodtimestobacco.com/sweepstake-terms-and-conditions/. To participate, you must have a registered GT Rewards account. If you are a potential winner, you will be contacted via email or phone based on the contact information associated with your GT Rewards account. If you do not have a GT Rewards account follow the following steps: If you are at least 21 years of age, just pick up a pouch of Good Times® products that contains a QR Code and scan with your smartphone’s camera. Enter the information as prompted to join. You can also join Good Times® rewards at https://rewards.goodtimestobacco.com/register/. It’s easy and there’s no cost to join.

Limits: There is no limit to Sweepstakes entries per person during the Sweepstakes Period; combining methods of entry will be accepted. Multiple entrants are not permitted to share the same email address or GT Rewards account. Any attempt by any entrant to obtain more than the stated number of entries by using multiple/different email addresses, identities, registrations, or logins, or any other methods, will void that entrant’s entries, and that entrant may be disqualified from the Sweepstakes. Any use of robotic, repetitive, automatic, programmed, or similar entry methods or agents (including, but not limited to, sweepstakes entry services) will void all entries by that entrant. In the event of a dispute as to any online entry via the GT Rewards Website or Application, the authorized account holder of the email address used to enter will be deemed to be the entrant. The “authorized account holder” is the natural person assigned an email address by an Internet access provider, online service provider, or other organization responsible for assigning email addresses for the domain associated with the submitted address or the natural person assigned a GT Rewards account by Good Times USA LLC or its agent. A potential winner may be required to show proof of being the authorized account holder.

Right of Publicity: Entrant agrees that the Sponsor may use or disclose his or her entry in whole or in part, commercially or noncommercially, in any media, in perpetuity, worldwide, including the right to publish and display the entry for advertising and publicity, and to edit and make derivative works, all without additional notification, review, approval or compensation to anyone, including the entrant. Additionally, each entrant agrees that the Sponsor may post the entry (including your name), or any portion thereof, on its website (www.goodtimestobacco.com), on webpages on third-party sites, or in any other media.

Right to Contact: All entrants consent to Sponsor’s right to contact the entrant after entrant’s entry into the Sweepstakes for purposes of Prize notification or other correspondence relating to the Sweepstakes. The Sponsor may contact an entrant by means of any correspondence or communication, including emailing, telephone calls, or text messages. By submitting an entry into the Sweepstakes, the entrant is consenting to use of his or her personal information as set forth in the Sponsor’s privacy policy at https://rewards.goodtimestobacco.com/privacy-policy/.

Prizes

There are 14 available to be won in the Sweepstakes; Prizes and Approximate Retail Value are listed in the Prize Table above (the “Prize”). Each Prize is non-transferable, non-negotiable, and non-divisible, unless otherwise stated in writing or agreed to in writing by the Sponsor. Each Prize consists of only those items specifically listed as part of the Prize. Any difference between the approximate retail value and actual cost will not be awarded. All features including but not limited to size, color, and variety of each Prize will be determined by the Sponsor. Unless otherwise noted in the specific rules on any Sweepstakes page, winners are solely responsible for all taxes, fees, or additional costs associated or related to collection, redemption, or use of any Prize.

If a potential winner is disqualified for any reason, Sponsor will award the applicable Prize to an alternate winner by random drawing from among all remaining eligible entries. Only fourteen (14) alternate drawings will be held, after which the Prize will remain unawarded.

Winner’s personal information related to a Sweepstakes entry, including, but not limited to, first and last names, full mailing address, phone number, and/or email address, may be shared with other persons or entities involved with the design, production, execution, or distribution of this Sweepstakes for the purpose of Prize awarding and delivery. Prizes will be shipped to the winners’ home addresses at no cost to the winners except in case of an Award of any Vehicle or where specifically noted in the specific rules on a Sweepstakes page, in which case those provisions apply. If a Sweepstakes page requires the winner to travel, at his or her own expense, to collect or redeem a prize, refusal or inability to do so shall result in his or her disqualification.

Each Prize is awarded “as is” with no warranty or guarantee, either expressed or implied by the Sponsor. Winners acknowledge that the Sponsor and all other persons and entities affiliated with this Sweepstakes and their agents do not make, nor are in any manner responsible for, any warranties or representations, expressed or implied, in fact or in law, relative to the quality, conditions, fitness, or merchantability of any aspect of the Prize being offered, except that the Prize shall be subject to its manufacturer’s standard warranty (if any).

Award of any Vehicle. Unless otherwise noted in the specific rules on any Sweepstakes page, winners are solely responsible for all taxes, costs, and fees associated with any vehicle receipt, ownership, tax, title, registration, tags, insurance and/or use. The winner must have a valid driver's license and proof of insurance, and the winner must take delivery of the vehicle at a location specified by Good Times USA, LLC. For any prize vehicle, neither the Sponsor, any Sweepstakes partner, nor the vehicle manufacturer has made nor is responsible or liable for any warranty, representation, or guarantee express or implied, in fact or law, relative to the prize vehicle, including but not limited to its quality, mechanical condition, or fitness. If a warranty is offered, it will and shall only be specifically and expressly made by the manufacturer or dealer of the vehicle. Notwithstanding the specific rules on any Sweepstakes page, a Sweepstakes involving a motor vehicle as a prize shall be limited to legal residents of the United States.

ODDS:

The odds of winning depend on the number of eligible entries received.

RANDOM DRAWING:

All eligible entries received during the Sweepstakes Period or, as applicable, postmarked during the Sweepstakes period and timely received will be gathered into a database at the end of the Sweepstakes Period. The drawing for the Prize will be randomly awarded to 14 potential winners among all eligible entries received during the Sweepstakes Period. The random drawing will be conducted on or around the drawing dates listed in Prize Table above. Entrants may only win once in the Sweepstakes.

PRIZE WINNER NOTIFICATION:

The potential winners will be notified via email or phone call (or by mail if required by law) by the Sponsor and/or a third-party prize fulfillment company and required to respond via return email or phone call and return completed any and all requested documentation, which may include but is not limited to an affidavit acknowledging the potential winner’s eligibility, proof of a valid driver’s license, IRS W-9 form, and publicity release (“Sweepstakes Documents”) within three (3) days from the time the award notification was sent unless otherwise indicated by the Sponsor. Each entrant is responsible for monitoring for notifications or other communications related to this Sweepstakes.

The Sponsor, other persons or entities involved with the design, production, execution, or distribution of this Sweepstakes, the fulfillment agencies of each, and all of their subsidiaries, affiliates, directors, employees, and agents (the “Sweepstakes Entities”) shall have no liability for any potential winner’s failure to receive notifications or other communications due to spam, junk email, or other security settings or for any potential winner’s provision of incorrect or otherwise non-functioning contact information. If a potential winner cannot be contacted, is ineligible, fails to claim the Prize, or fails to provide the Sweepstakes Documents within three (3) days from the time the award notification was sent (or seven (7) days in the case of a mail notification), or fails to return fully completed and executed Sweepstakes Documents as required, the Prize may be forfeited, and an alternate winner may be selected. Up to three (3) alternates may be selected as time permits for reasonable awarding of the Prize. If all alternates fail to claim the Prize, the Prize may remain unawarded at the discretion of the Sponsor.

If a winner fails to comply with these Official Rules, that winner will be disqualified. ALL FEDERAL, STATE, AND LOCAL INCOME TAXES ON PRIZES AND EXPENSES RELATING TO ACCEPTANCE, COLLECTION, REDEMPTION, AND USE OF PRIZES NOT SPECIFIED ARE THE SOLE RESPONSIBILITY OF THE WINNER.

Illegible, unintelligible, or incomplete entries or responses will be disqualified. The Sweepstakes Entities are not responsible for any late, misdirected, or undelivered entries or other Sweepstakes-related communications.

 NO LIABILITY:

 By entering the Sweepstakes, entrants agree to these Official Rules and all decisions of the Sponsor. Entrants release, discharge, indemnify, and hold harmless the Sweepstakes Entities from all claims and liability relating to their participation in the promotion, and the acceptance and use/misuse of any Prize offered. Entrants assume all liability for any injury or damage caused or claimed to be caused by participation in this Sweepstakes or use/misuse or redemption of the Prize. The Sponsor is not responsible for any typographical or other error in the printing of the offer, administration of the Sweepstakes, or in the announcement of the Prize. Additionally, the Sweepstakes Entities are not responsible for technical, network, electronic, computer, hardware, or software failures of any kind, including any injury or damage to any entrant's or any other person’s computer related to or resulting from participating in or downloading any materials related to the Sweepstakes.

 

This Sweepstakes is in no way sponsored, endorsed, or administered by, or associated with Facebook, X (formerly known as Twitter), or any other social platforms. Entrants are providing their information to Good Times USA LLC and not to Facebook, X, or any other social media platforms. The Sweepstakes is in no way affiliated with Apple or Google.

ADDITIONAL LIMITATIONS:

If for any reason this Sweepstakes is not capable of running as planned due to an infection by a computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsor that corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Sweepstakes, the Sponsor reserves the right, at its sole discretion, to disqualify any individual who tampers with the entry process and to cancel, terminate, modify, or suspend the Sweepstakes, at which time, the Sponsor may conduct a random drawing from among all eligible entries received at the time of the termination of the Sweepstakes. The Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. The Sponsor is not responsible for any problems or technical malfunctions or any telephone network or telephone lines, computer on‑line systems, servers, or providers, computer equipment, software, failure of any email or entry to be received by the Sponsor due to technical problems, human error, or traffic congestion on the Internet or at any website, or any combination thereof, including any injury or damage to an entrant’s or any other person’s computer relating to or resulting from participating in this Sweepstakes or downloading any materials for this Sweepstakes.

In the event the Sponsor is prevented from continuing with the Sweepstakes as contemplated herein by any event beyond its control, including but not limited to fire, flood, natural or man-made epidemic of health or other means, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared) or any federal, state or local government law, order, or regulation, public health crisis, order of any court or jurisdiction, or other cause not reasonably within the Sponsor’s control (each a “Force Majeure” event or occurrence), then, subject to any governmental approval that may be required, the Sponsor shall have the right to modify, suspend, or terminate the Sweepstakes. Only the type and quantity of prizes described in these Official Rules will be awarded. If, due to printing, production, or human errors, or for any reason, more potential winners in any prize category come forward seeking to claim prizes in excess of the number of each type of prize as set forth in these Official Rules, the winners, or remaining winners, as the case may be, of the advertised number of prizes available in the prize category in question may be selected in a random drawing from among all persons making purportedly valid claims for such prize(s) in that prize category. Inclusion in such a drawing shall be each entrant’s sole and exclusive remedy under such circumstances.

Illegible, unintelligible, or incomplete entries or responses will be disqualified. The Sweepstakes Entities are not responsible for any late, misdirected, or undelivered entries.

It is each entrant’s responsibility to ensure compliance in all respects with these Official Rules. The Sponsor reserves the right, in its sole discretion, to disqualify any individual who: tampers with the entry processes or the operation of the Sweepstakes; acts in violation of these Official Rules; or acts with the intent to disrupt or undermine the legitimate operation of the Sweepstakes, or to annoy, abuse, threaten or harass any other person. The Sponsor reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law.

 

PUBLICITY:

 

Except where prohibited by law, entry into the Sweepstakes and acceptance of the Prize constitute permission to use the winner’s name, the Prize won the winner’s hometown, likeness, photographs, and statements as well as videos of the winner for purposes of advertising, promotion, and publicity (including online posting) in any and all media now or hereafter known throughout the world in perpetuity, without additional compensation, notification, or permission. Except as expressly stated in these Official Rules, no substitution, cash redemption, or transfer of the Prize is allowed, but the Sponsor reserves the right to substitute for the advertised Prize a prize of equal or greater value if the advertised Prize becomes unavailable or for any other reason.

Entry into the Sweepstakes and acceptance of the Prize constitute agreement by the winner to participate in a promotional video and/or interview with or on behalf of the Sponsor, on the Sponsor’s request. Such promotional video and/or interview will be recorded or occur either in-person in Tampa, Florida, or online through use of mutually agreed upon video conferencing software, if requested by the winner, on a date and time to be mutually agreed upon by the Sponsor and the winner. Unless agreed upon in writing, in no case shall the Sponsor be responsible for the winner’s travel, accommodation, or any other costs or expenses related to participation in the promotional video or interview.

INVALIDITY:

These Official Rules cannot be modified or amended in any way except in a written document issued in accordance with law by a duly authorized representative of the Sponsor. The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Official Rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any Sweepstakes materials and these Official Rules, these Official Rules shall prevail, govern, and control.

CHOICE OF LAW AND VENUE:

 

Except where prohibited, each entrant agrees that any and all disputes, claims, and causes of action arising out of, or connected with, the Sweepstakes or any Prize awarded, or the determination of the winner, shall be resolved individually, without resort to any form of class action. All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, an entrant’s rights and obligations, or the rights and obligations of the Sponsor or the Sweepstakes Entities in connection with the Sweepstakes shall be governed by, and construed in accordance with, the laws of the State of Florida, without regard for conflicts of law doctrine, and all proceedings shall take place in Hillsborough County, State of Florida. Any and all claims, judgments, and awards in connection with the Sweepstakes shall be limited to actual out-of-pocket costs incurred in connection with such Sweepstakes but in no event attorney's fees; and under no circumstances will an entrant be permitted to obtain awards for, and entrants hereby waive all rights to claim, punitive, incidental, and consequential damages and any other damages, other than actual out-of-pocket expenses. Entrants also hereby waive all rights to have damages multiplied or otherwise increased. Either party may elect binding arbitration, and, if selected, any controversy or claim arising out of or relating to this contract, or the breach thereof, shall be settled by arbitration administered by the American Arbitration Association in accordance with its Commercial (or other) Arbitration Rules (including the AAA Optional Rules for Emergency Measures of Protection), and judgment on the award rendered by the arbitrators may be entered in any court having jurisdiction thereof and in conformity with this section relating to jurisdiction.

THE PARTIES HEREBY WAIVE THEIR RIGHT TO JURY TRIAL WITH RESPECT TO ALL CLAIMS AND ISSUES ARISING OUT OF OR RELATING TO THE SWEEPSTAKES WHETHER SOUNDING IN CONTRACT OR TORT, INCLUDING ANY CLAIM FOR FRAUDULENT INDUCEMENT.

PRIVACY:

Personal information collected from online entrants is subject to the Sponsor’s privacy policy at https://rewards.goodtimestobacco.com/privacy-policy/.

WINNERS LIST:

An official winners list will be available at GT Sweepstakes – Good Times Rewards (goodtimestobacco.com) for a minimum of 30 days following winner confirmations after the end of the Sweepstakes Period.

IN NO EVENT SHALL THE SPONSOR BE LIABLE TO ANY ENTRANT OR PROSPECTIVE ENTRANT, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE, FOR ANY INDIRECT, EXEMPLARY, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES HOWEVER CAUSED, EVEN IF THE SPONSOR HAS BEEN NOTIFIED IN ADVANCE OF SUCH POSSIBILITY, ARISING OUT OF OR PERTAINING TO THE SWEEPSTAKES. THE SPONSOR AND THE SWEEPSTAKES ENTITIES ARE NOT RESPONSIBLE AND SHALL NOT BE LIABLE FOR: (A) ANY ERROR THAT MAY OCCUR IN THE PROCESSING OF ANY AND ALL ENTRIES; (B) LOST, LATE, OR MISDIRECTED ENTRIES; OR (C) ANY CONDITION CAUSED BY EVENTS THAT MAY CAUSE THE SWEEPSTAKES TO BE DISRUPTED OR CORRUPTED.
